DepthChartIQ Terms of Service and User Agreement

The short version.Be honest. Don’t break things. The product is decision support, not a guarantee. Predictions are probabilistic — not promises about your career. We’re a tool to help you and the people who advise you make better decisions.

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the DepthChartIQ™ website at depthchartiq.ai and related services (the “Service”), provided by DepthChartIQ, Inc. (“DepthChartIQ,” “we,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. The Service is not directed to children under 13, and we do not permit account creation by anyone under 13. If you are between 13 and 17, a parent or legal guardian must confirm consent to these Terms and our Privacy Policy through a confirmation we send to their email before your account can be activated; activation is blocked until that consent is recorded. If you are using the Service on behalf of an organization (e.g., an athletic department), you represent that you are authorized to bind that organization to these Terms.

3. Account and accuracy

You agree to provide accurate information when signing up and to keep that information current. You are responsible for activity on your account. Notify us promptly of any unauthorized access at [email protected].

4. The Service is decision support — not a guarantee

DepthChartIQ™ provides probabilistic predictions and structural information to support athlete decisions. The outputs are not guarantees, promises, or commitments about future playing time, performance, recruitment, transfers, scholarships, name-image-likeness opportunities, or any other outcome.

Your athletic and academic decisions are your own. We strongly recommend consulting with coaches, advisors, family, and any compliance officials before making material decisions based on the Service.

5. NCAA, conference, and institutional rules

Athletic eligibility, transfer eligibility, recruiting rules, and NIL rules are governed by the NCAA, the NAIA, the NJCAA, individual conferences, and individual institutions. DepthChartIQ is not affiliated with the NCAA or any other governing body and does not provide compliance advice. You are solely responsible for understanding and complying with all rules that apply to you.

6. Acceptable use

You agree not to:

Use the Service to violate any law or regulation;
Reverse-engineer, scrape, or attempt to extract our predictive models or proprietary scoring methodology beyond what is publicly disclosed;
Misrepresent your identity, role, or affiliation;
Use the Service to harass, harm, or impersonate others;
Interfere with the security or operation of the Service.

7. Intellectual property

The Service, including all software, content, design, scoring methodology, the Success Probability Score℠ and Roster Pressure Score℠, and all associated trademarks (including DepthChartIQ™), is owned by DepthChartIQ or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

8. Free access and paid tiers

DepthChartIQ offers a free tier at all times. During the Early Access period, members additionally receive Premium features at no charge through October 14, 2026. Beginning October 15, 2026, the DepthChartIQ Pro plan (monthly or annual billing) applies at then-current pricing shown on our pricing page, and we will provide notice before any charge. Eligible first-time subscribers receive one 7-day free trial. You may continue on the free tier without charge.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PREDICTION WILL MATCH ANY SPECIFIC OUTCOME.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEPTHCHARTIQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any such limitation is not enforceable in your jurisdiction, the limitation will apply to the maximum extent permitted.

11. Indemnification

You agree to indemnify and hold harmless DepthChartIQ from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive (including IP, disclaimers, limitations of liability, and dispute resolution).

13. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or prominent notice on the Service before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable rights you may have under the law of your jurisdiction.
