1. What this policy covers

This Privacy Policy describes how DepthChartIQ, Inc. (“we,” “us,” or “DepthChartIQ”) collects, uses, and shares information when you use our website at depthchartiq.ai or any related services (the “Service”). It applies to all users of the Service regardless of location.

2. Information we collect

We collect information in three ways:

• Information you give us— your email address, role (athlete, parent or family, or coach, advisor or AD), a birth year, any free-text note you choose to share when signing up, and any profile information you provide; your date of birth; if you are 13 to 17, the email address of the parent or guardian you name; the email address of any family member you invite; if you are a parent or guardian, your confirmation of an athlete’s account.
• Public sports data — athletic performance data and roster information derived from publicly available sources (e.g., team rosters and season statistics) is used to provide and operate the Service. We do not represent any of this public data as private to you.
• Usage data — basic technical information your browser sends automatically (IP address, browser type, pages visited, timestamps) used for security, fraud prevention, and product analytics.

3. How we use information

We use the information we collect to:

• Provide, maintain, and improve the Service, including generating and refining predictive outputs;
• Communicate with you about the Service, including early access invitations and important notices;
• Detect, prevent, and respond to fraud, abuse, security, and technical issues;
• Comply with legal obligations and enforce our Terms of Service.

We do not use your personal information to train models that are sold or licensed to third parties.

4. How we share information

We do not sell your personal information. We share information only in these limited cases:

• Service providers — vendors who help us operate the Service (e.g., email delivery, hosting, analytics) under contractual confidentiality and data-protection obligations;
• Legal requirements — if required by law, subpoena, or other legal process, or to protect the rights, safety, or property of DepthChartIQ, our users, or the public;
• Business transfers — in connection with a merger, acquisition, or sale of assets, in which case we will provide notice before your information is transferred and becomes subject to a different privacy policy.

5. Children and minors (COPPA)

We ask for a date of birth before anyone creates an account. If it shows the person is under 13, we stop: we do not create an account and we do not keep the date or anything else they entered. If we learn that we collected personal information from a child under 13 anyway, we delete it promptly.

If you are 13 to 17, your account stays on hold until a parent or legal guardian confirms it through a link we email to them. While it is on hold we keep only your name, email address, date of birth and your parent or guardian’s email address. We delete an account that is not confirmed within 30 days.We use the parent or guardian’s email address only to send that request and its reminders.

When a parent or guardian confirms, we keep a record of their email address, when they confirmed, and the version of the consent text they saw.

We store the full date of birth on the account to apply these rules and to know when an athlete turns 18. We do not send it to analytics providers and we do not use it for advertising. We do not load analytics on the date-of-birth and parent-confirmation pages, we do not record sessions or send analytics identifiers for accounts on hold, and we stop analytics in a browser after someone enters a date of birth under 13.

A parent, guardian or family member linked to an athlete’s account sees the athlete’s information only to the extent the athlete chooses to share it. A parent or legal guardian may access, correct, export or delete a minor’s information, or withdraw consent, at any time by contacting [email protected].

6. Educational records (FERPA)

DepthChartIQ is not an educational institution and does not receive information from school records protected by the Family Educational Rights and Privacy Act (FERPA). We rely on publicly available athletic performance and roster data and on information you provide to us directly.

7. Your rights

Depending on where you live, you may have rights under applicable law (including the California Consumer Privacy Act / CPRA, the EU General Data Protection Regulation, the UK GDPR, and similar state and national laws). These may include:

• The right to access the personal information we hold about you;
• The right to correct inaccurate information;
• The right to delete your personal information, subject to certain exceptions;
• The right to portability — receive your information in a portable format;
• The right to opt out of certain processing, including any sale or sharing of personal information (we do not sell);
• The right to not be discriminated against for exercising these rights.

How deletion applies to different information. You may request deletion of the information you have provided to us — your account and profile data — and we will remove it upon verified written request, subject to legal exceptions. Athletic performance and roster information we derive from publicly available sources is not removed on request, because it is drawn from public records rather than provided by you. If you are the subject of a prediction and have a concern about it, contact [email protected] and we will review your request consistent with applicable law.

8. International transfers

We are based in the United States and process information there. If you access the Service from outside the United States, your information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to this transfer.

9. Data retention

We retain personal information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion at any time by contacting us.

10. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.

11. Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email and post a prominent notice on the Service before the changes take effect.
